Statement concerning the Protection of your Personal Data pursuant to Legislative Decree 196/2003. Dear Sir/Madame, Law No. 675 of 31 December 1996 (Privacy Act), providing for protection of the privacy of the individual and/or other legal entities in personal data processing, was repealed by Legislative Decree No. 196 of 30/6/2003 and entirely replaced by it . The more recent act introduced a new set of regulations for Personal Data Protection guaranteeing that such data, and especially sensitive personal data such as that regarding a person’s state of health, is processed with full respect for the rights, fundamental liberties, dignity and privacy of the interested party. The term “processing of personal data”, pursuant to Art. 1 of the above-referenced law, refers to any operation or series of operations carried out with or without the use of electronic means which involves the collection, recording, organisation, storage, consultation, elaboration, modification, selection, extraction, comparison, use, interconnection, blockage, communication, distribution, cancellation, and destruction of data, even if not included in a data bank. We would like to inform you that the data, including sensitive data, supplied to us in connection with your order, are and will be handled, whether manually or electronically, in accordance with the rules of legality and correctness provided for in the previously cited law, as well as with complete respect for your right to privacy, by Domino SpA, its employees and subcontractors. We would like to inform you, therefore, that the information supplied will be used for the following purposes: - to process your orders and to complete registration for the services requested; - to comply with legal requirements; - to meet administrative and operational requirements. The data will not be given to other parties, nor will it be distributed in any way. It will be handled using methods suitable to guarantee the security and confidentiality of the information. This may be done using electronic systems for memorizing, managing and transmitting data. We inform you, as well, that under this law certain specific rights are conferred on the individual. In particular, the interested party may ask the proprietor whether the company possesses his personal data or not and request that this data be made available to him in an intelligible form. The interested party may also ask: - to know the source of the data as well as the processing methods and the purpose for which it was collected; - to request the cancellation, transformation or blockage of data that is not processed in accordance with law; - to request the updating, correction, or, if there is an interest, the completion of the data; - to object to the processing of the data, if for legitimate reasons. Domino SpA, with its registered offices at Via delle Industrie 16/18 - 23896 Sirtori (LC), as proprietor of the information and the party responsible for its processing, has delegated this responsibility to its General Management. Domino SpA stores the personal data processed in compliance with the statutory regulations provided for in the "Code for the Protection of Personal Data" as well as in accordance with its internal Security Program, to reduce to a minimum the risks of destruction or loss, also of an accidental nature, as well as unauthorized access or processing not in compliance with the terms or for a purpose other than that specified. The processing of the data will be done within the company and respecting the principles of necessity and pertinence: the data supplied will be processed by us manually or using a computer system where it will be stored in a way that will guarantee its security and confidentiality using methods and technologies designed to guarantee that the data is accessible only to the responsible party and those he appoints to process the data pursuant to law. The storage of the data may continue even after relations cease for the purposes specified as well as for the purpose of maintaining a record of the company’s historical activities. Regarding the latter purpose, we would like to inform you that the data will be kept for a period of not more than 10 years from the date that all relations with you have ceased. We also inform you that the Personal Data may become the knowledge of those appointed to handle the processing and it may also be given to external assistants, professionals or non-professionals, for the purposes outlined above as well as to those parties which require the data in order to perform under your contract. The data may also be shared with others to meet contractual, legal, fiscal, or administrative requirements or during inspections by the Financial Authorities or agents of the Tax and Fiscal Administration or with any other body in charge of inspections and controls relating to the regular fulfilment of obligations required by law. The data may be processed using companies, associations, or consortiums that supply our company or another company of the Group with specific IT services. The data may also be used for promotional purposes. It may also be transferred to EU Member States or third countries, outside the EU, for the indicated purposes. The supplying of the data is optional, but any refusal to supply the data, in whole or in part, or the expression of non-acceptance of the use of the same could make it impossible to carry out the purposes indicated. Legislative Decree 196/2003 Art. 7 in conjunction with the responsibilities which fall on Domino SpA in carrying out the responsibilities assigned and the services offered, confers on you the following specific rights: a)the right to obtain a confirmation of the presence or absence of your Personal Data in its possession, even if it is not recorded as yet, and to request that it be shown to you in an intelligible form; b)the right to obtain an indication of: 1)the source of the Personal Data 2)the purposes and methods used for its processing 3)the logic applied in the case of processing by electronic means 4)the identifying information of the proprietor, of those responsible for processing and of the representatives designated pursuant to Art. 5, paragraph II of the Civil Code 5)the parties and categories of parties to whom the data may be communicated and which may have knowledge of it in virtue of their qualification as designated national representatives. You will also have the right to obtain: 1)the updating, rectification, or when of interest, the completion of the data; 2)the cancellation of the data, the transformation in anonymous form or the blockage of data processed in violation of the law, including those for which storage is not necessary for the purposes declared when collected or subsequently processed; 3)the certification that all those to whom the data was communicated or distributed are informed of the operations described in points 1 and 2, unless doing so would be impossible or would require an effort completely disproportionate to the requirement of protection of privacy.
